General Provisions
These service rules govern the relationship between the Provider (the Service Provider) - VPSNow, and the end user (you). Your payment for the Provider's services constitutes your acceptance of these rules. The Provider reserves the right to amend these rules by publishing a new version on the Provider's website. If you do not agree with any provisions of these rules or with the amendments made, you are obliged to stop using the Provider's services.
Administration
Unless otherwise agreed with the Client in writing, the Client administers his VPS server himself. This means that he, and he alone, configures the OS, installs additional software, resolves all problems that arise on his own, and creates and keeps up to date backup copies of data. All administration services, including administration consultations, are provided for a separate fee. System administration services (including consultations) are additional, and the Provider may refuse to provide them without giving reasons.
Limitation of Liability of the Parties
By using the services provided by the Provider, the Client assumes any risks associated therewith. The Provider gives the user no warranties other than those expressly stated in this document. In particular, the Client agrees that the Provider will not consider any claims relating to lost profit, loss of business reputation, expenses incurred, or moral damage.
The Client bears full responsibility for the safekeeping of passwords and other confidential information. The Provider bears no responsibility whatsoever for any consequences caused by the Client's loss of passwords. All actions performed using the Client's password are deemed to have been performed by the Client.
The Client confirms his understanding that, outside the DC network, the Provider cannot be held responsible for the quality of communication channels, including data transfer speed, ping, network delays, packet loss, the routing rules used, the availability of individual nodes or subnets, the operation of internet providers or the actions of third parties, and other circumstances beyond the Provider's control which may impede the subscriber's use of the services provided. The Provider's area of responsibility is limited exclusively to the DC's internal network up to the point of interconnection with direct backbone providers.
The services are provided by the Provider "as is", which implies the absence of any guarantees to make changes or eliminate defects at the Clients' request. In particular, this also applies to the operation of the software products used (including the Microsoft Windows OS) with the defects and limitations present in them.
Verification and Control of Clients' Contact Information
When placing a VPS order, the Client is obliged to provide truthful and accurate information about himself (full name, country and city of actual residence, e-mail address and contact telephone number). If the Provider establishes that the data provided does not correspond to reality, the user may be refused further provision of services without a refund of the funds paid.
Within 12 hours after activation of the VDS server, the user is obliged to verify the telephone number provided at registration by means of the automatic verification in the Client Area. The servers of clients who have not passed verification within the established period will be automatically blocked until it is successfully completed. If the telephone verification has not been completed by the client within 7 days after activation, the VDS server will be deleted without a refund of payment.
In order to verify the data provided when placing the order, the Provider has the right to require, and the Client is obliged to provide, supporting documents. If the requested documents are not provided within 7 days from the date of the request, or if their authenticity / ownership by the client is not reliably confirmed, the user will be refused further provision of services without a refund of the funds paid.
Mailings and Notifications
By placing an order, the Client agrees to receive informational mailings (including news), automatic notifications by e-mail and in Telegram relating to the Provider's services.
The Provider does not guarantee, and bears no responsibility for, the delivery of the said mailings and notifications.
Settlements and Payment
Payment for the Provider's services is made by the Client on a prepayment basis - the Client pays for the services in advance, according to the invoices issued or by topping up the account himself with the required amount.
If payment of an invoice is overdue by more than 3 days, the Client will be charged a penalty of 10% of the amount of the overdue invoice, but not less than 1 Euro.
VPS servers whose paid period has expired are automatically blocked. Within 7 days from the moment of blocking, the user may renew such a VPS, after which it will be automatically unblocked and the user will be able to continue using it.
If the VPS has not been renewed within 7 days from the moment of blocking, it will be automatically deleted, and a separate invoice will be issued to the client for the period during which the server was blocked. Resumption of service (including if the client places a new order or registers anew under different details) is possible only after the outstanding debt has been repaid.
The cost of unblocking a VPS server for 1 day to enable the download of a data backup is 5 euros.
The Client is obliged to monitor the paid period himself and to renew the services in good time. The Provider does not guarantee the delivery of e-mail notifications to the Client's e-mail address and bears no responsibility for possible failures in the operation of the mail system.
The Provider will not consider any claims regarding loss of data associated with the deletion of servers due to payment arrears.
Payment for services is accepted by bank card, via Google Pay and Apple Pay, and by bank transfer to the Provider's bank account by IBAN. The price of the services is stated in euros; when paying in another currency, the amount is converted at the rate set by the Provider on the date of payment.
The Provider bears no responsibility for any additional expenses incurred by the Client when paying for services (payment system fees, exchange office fees, etc.).
VPSNOW reserves the right to block all VPS servers (including paid ones) of a Client who has an unpaid debt. In this case, the paid period of such servers is taken into account regardless of the fact of blocking. After the end of the paid period, such servers will be deleted in the general order. Deletion of a VPS server or refusal of service does not release the Client from the obligation to repay the outstanding debt.
Changing the Tariff Plan
An upgrade (transition to a larger tariff plan with the data existing on the server preserved) is possible only if there is a technical possibility of carrying it out. If there is no such possibility, the upgrade will be postponed until it becomes available.
The minimum surcharge in the event of an upgrade is 5 euros.
The cost of transition to a tariff plan with a lower monthly cost (downgrade) is 10 euros. The transition is carried out only after the end of the current paid period; in the case of a transition before the end of the paid period, no recalculation is made. The change of configuration must be technically possible.
Guarantee of Fixed Monthly Price
The Provider reserves the right to change the monthly cost of the services at any time by publishing new prices on the website. At the same time, the cost of VPS already paid for remains unchanged throughout the entire term of their lease and cannot be changed by the Provider.
Termination of the Agreement at the Client's Initiative
The Client may at any time refuse the Provider's services by creating a corresponding request in the Personal Account, stating in it the reason for his refusal. Creating a request to cancel the server is a mandatory condition for termination of the agreement. If the client has not created a request to cancel the server, he is obliged to pay all invoices issued by the Provider, regardless of whether or not he used the services rendered to him.
In the event of early termination of the agreement at the Client's initiative, the unused part of the prepayment is refunded: the months used (including the month that has started) are recalculated at the plan's standard monthly price without the prepayment discount, and the remainder is returned to the Client. No refund is made if the agreement is terminated because of the Client's violation of these rules.
Account Closure Fee
In the event of refusal of service due to a violation of the service rules, a fee for closing the account, equal to the remaining balance of funds, is debited from the account balance.
Order Cancellation and Refund Policy
Within 7 days after activation of the first order, the Client may cancel the services without giving a reason and receive a full refund (trial period).
After the trial period ends, a refund is made in the event of early termination of the agreement at the Client's initiative (as described in the section "Termination of the Agreement at the Client's Initiative"), and also when the Provider refuses to render the paid services. No refund is made if the termination of the agreement or the refusal of service is connected with the Client's violation of these rules.
Safety of Data on VPS Servers
Under no circumstances does the Provider bear responsibility for the safety of data on the Client's VPS server. The Client is obliged to regularly create, on his own, backup copies of all data that is important to him and to monitor that they are up to date. The Client is obliged to keep backup copies of all data important to him on his own computer or on external storage. In the event of failures in the operation of the disk subsystem or loss of VDS data for other reasons, the Provider will reinstall the Client's VPS and communicate new access details. The Client undertakes not to bring any claims against the Provider relating to the loss of data, and also to protect the Provider from possible claims by third parties.
Confidentiality of Data on VPS Servers
The Provider guarantees the confidentiality of data (files) uploaded by the user to his VPS server, which implies that the Provider's employees cannot deliberately transfer or disclose such data to third parties or use it for their own purposes, and also guarantees the deletion of all of the user's data (files) (including existing backup copies) upon deletion of his VPS server.
This guarantee does not extend to any cases where access to the data was obtained using the Client's access credentials (for example, in the event of a hack of the VPS server, theft of information by means of a password stolen or obtained from the user by deception, etc.), cases of seizure of information by law enforcement authorities, and also other cases where the Provider, for reasons beyond its control, has no actual ability or legal grounds to ensure a confidentiality regime.

- 7.4. to notify the Reseller in advance of all changes to the rules and procedure for the provision of services;
Applicable Law
All legal relations, as well as possible disputes, between the Provider and the Client are governed in accordance with the legislation of Ukraine.
Terms and Procedure for Traffic Accounting
- 1. The tariff plan specifies the total amount of traffic (the volume of data transmitted over the network) provided to the Client during a calendar month at a speed of 100mbit/sec.
- 2. Traffic is counted per calendar month (from the 1st to the 1st day of the month), regardless of the billing period for the lease of the server.
- 3. Accounting is based on the statistics of the corresponding network interface of the master node on which the virtual server is located.
- 4. The statistics count all network traffic (incoming + outgoing).
- 5. If the limit is exceeded, access to the server will be blocked until the end of the month.
- 6. Unblocking is performed automatically on the 1st day of the following month.
- 7. Additional traffic costs 2€ per 1 000GB on a monthly payment basis. The month in which the order is placed is paid in full, regardless of the date of the order.
- 8. No traffic ratios need to be observed.
- 9. The Client is obliged to monitor the volume of traffic consumed himself.
